Empire Bay Marina shut down for safety breaches

The NSW Government has revoked the licence of the Empire Bay Marina due to ongoing safety and environmental concerns.

Parliamentary Secretary for the Central Coast and Member for Terrigal Adam Crouch said the Department of Planning, Industry and Environment – Crown Lands had taken action following repeated requests and actions to the management of Empire Bay Marina.

“Ongoing breaches of licence conditions by the operator of Empire Bay Marina have created a significant risk to occupants, public health and safety, and the environment,” Mr Crouch said.

“Crown Lands has worked to have the Marina operators comply with their licence conditions since 2018 but, despite repeated notices, warnings and fines, the site issues were never properly addressed, forcing this compliance action.”

“This has also been an ongoing source of community concern for many months now.

“Crown land includes waterways and foreshore land, and the community has a right to feel confident that Crown land is being looked after and occupied by tenants in an appropriate and safe way.”

Mr Crouch said the issues include safety hazards, a lack of pollution control, structural defects in the boatshed, and encroachment on adjoining land.

“Crown Lands has now taken control of the site and has commenced actions to quickly address these safety hazards,” Mr Crouch said.

“The site has also been secured with fencing after a building condition assessment confirmed that the boatshed is structurally defective and unsafe for occupation.”

Vessel owners who have been using the Marina are being requested to seek alternative mooring locations. Vessel owners can access their vessels with authorisation of Crown Lands by email maitland.crownlands@crownland.nsw.gov.au or phone 1300 886 235.
